Acceptance of Terms

Effective Date: September 15, 2025

These Terms of Service ("Terms") are a legally binding agreement between you and PharmaWeb ("PharmaWeb," "we," "us," or "our") governing your access to and use of the website located at pharmaweb.net and any related content, features, or services that reference these Terms (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

You represent and warrant that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an entity, you represent that you are authorized to bind that entity, and "you" refers to both you and that entity.

About PharmaWeb; Informational Use Only

PharmaWeb is an online resource providing general information about pharmaceuticals, medications, diseases, and supplements. All content is provided for educational and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. The Service does not provide medical or pharmaceutical practice, clinical services, or professional healthcare advice, and no doctor–patient, pharmacist–patient, or other professional relationship is created by your use of the Service.

Always seek the advice of your physician, pharmacist, or other qualified health provider with any questions you may have regarding a medical condition, medication, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read on the Service. Eligibility and Geographic Scope

The Service is intended for individuals at least 13 years of age. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may use the Service only with the consent of your parent or legal guardian, who must review and accept these Terms on your behalf.

The Service is controlled and operated from the United States. We make no representations that the Service or its content is appropriate or available for use in other locations. You are responsible for compliance with local laws, if and to the extent local laws are applicable.

We may update these Terms from time to time. The "Effective Date" above reflects the latest revision. Changes take effect upon posting unless otherwise stated. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

We may modify, suspend, or discontinue the Service, in whole or in part, at any time without notice, and without liability to you.

Privacy

Your use of the Service may involve the collection and processing of information as described in our privacy practices. We are not a covered entity or business associate under the Health Insurance Portability and Accountability Act (HIPAA). Do not submit protected health information (PHI) or other sensitive personal information through the Service.

You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach. All content and materials on the Service, including text, graphics, logos, icons, images, audio, video, data compilations, software, and compilations thereof, are owned by PharmaWeb or its licensors and are protected by U.S. and international intellectual property laws. PharmaWeb and associated logos are trademarks of their respective owners. No rights are granted except as expressly set forth in these Terms.

User Content and Submissions

If you submit, post, or transmit any content, feedback, questions, reviews, or suggestions ("User Content"), you grant PharmaWeb a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such User Content in connection with operating, improving, and promoting the Service. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any law or the rights of any third party.

We may, but have no obligation to, monitor, remove, or edit User Content at our discretion.

Prohibited Conduct

  • Using the Service in violation of any applicable law or regulation.
  • Providing false, misleading, or fraudulent information.
  • Engaging in activity that is harmful, harassing, defamatory, obscene, or otherwise objectionable.
  • Accessing or attempting to access non-public areas of the Service or interfering with its operation.
  • Introducing malware, viruses, worms, or other harmful code.
  • Infringing or misappropriating the intellectual property or privacy rights of others.
  • Scraping, crawling, or harvesting content or personal information without authorization.
  • Using the Service to provide medical advice or to claim professional qualifications you do not have.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PHARMAWEB OR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; IN SUCH CASES, THE FOREGOING LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED.

Indemnification

You agree to indemnify, defend, and hold harmless PharmaWeb and its owners, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.

DMCA Copyright Policy

Notice of Claimed Infringement (17 U.S.C. § 512(c))

If you believe that content on the Service infringes your copyright, please send a written notice to our Designated Agent with the following information: (1) a physical or electronic signature of the copyright owner or authorized agent; (2) identification of the copyrighted work claimed to have been infringed; (3) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material; (4) your contact information; (5) a statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and (6) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Counter-Notification (17 U.S.C. § 512(g))

If your content was removed due to a DMCA notice and you believe the removal was in error, you may send a counter-notification that includes: (1) your physical or electronic signature; (2) identification of the material removed and the location at which it appeared before removal; (3) a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and (4) your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for your judicial district (or King County, Washington, if outside the U.S.) and will accept service of process from the person who provided the original DMCA notice.

Repeat Infringer Policy

It is our policy to terminate, in appropriate circumstances, users who are repeat infringers.

Arbitration Agreement and Dispute Resolution

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by sending a written notice describing the dispute and relief sought to [email protected]. If the dispute is not resolved within 30 days of our receipt of your notice, either party may initiate arbitration as described below.

Binding Arbitration

Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration agreement. The arbitration will be conducted by a single arbitrator, in English, and may be held via documents-only, teleconference, or in King County, Washington, at your election.

Class Action Waiver

YOU AND PHARMAWEB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, AND THE ARBITRATOR MAY NOT CONSOLIDATE PROCEEDINGS OR OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

Opt-Out

You may opt out of this arbitration agreement by sending written notice of your decision to opt out within 30 days of first accepting these Terms to PharmaWeb, Attn: Arbitration Opt-Out, 10 W Sunset Way, Issaquah, WA 98027, or by email to [email protected] with the subject line "Arbitration Opt-Out." Your opt-out will apply only to this arbitration agreement.

Exceptions

Either party may bring an individual action in small claims court or seek injunctive or other equitable relief in a court of competent jurisdiction for intellectual property infringement or misuse.

Fees

Payment of filing, administration, and arbitrator fees will be governed by the AAA rules. We will reimburse consumer filing fees for claims totaling less than $10,000 unless the arbitrator determines your claims are frivolous.

Governing Law and Venue

These Terms and any dispute arising out of or related hereto are governed by the laws of the State of Washington, without regard to its conflict of law principles, except that the Federal Arbitration Act governs the arbitration agreement. Subject to the arbitration agreement, the state and federal courts located in King County, Washington, will have exclusive jurisdiction for any claims that are not subject to arbitration, and you consent to personal jurisdiction and venue in those courts.

Electronic Communications and Notices

By using the Service, you consent to receiving communications from us electronically. We may provide notices by email, by posting to the Service, or by mail to the address you provide. Notices to PharmaWeb must be sent to the contact information below.

Export and Sanctions Compliance

You represent that you are not located in, under the control of, or a national or resident of any jurisdiction or entity subject to U.S. embargoes, sanctions, or export restrictions. You agree to comply with all applicable U.S. export control and sanctions laws.

Children’s Use

The Service is not directed to children under 13. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will take reasonable steps to delete it.

Accessibility

We strive to provide accessible content. If you experience difficulty accessing any content on the Service, please contact us so we can assist and improve accessibility.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any or no reason, including if we believe you have violated these Terms. Upon termination, the rights and licenses granted to you terminate immediately, except that any provisions which by their nature should survive will survive, including ownership provisions, warranty disclaimers, limitations of liability, indemnities, and dispute resolution terms.

Severability; Waiver; Assignment; Entire Agreement

If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be a waiver of such right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction. These Terms constitute the entire agreement between you and PharmaWeb regarding the Service and supersede all prior or contemporaneous understandings.
